Haywood Co.} Whereas the taxes on such part of a certain tract of land lying on SCOTT’s Creek in the co. aforesaid and the reputed property of William CATHEART to which the Indian claim has been extinguished remain due and unpaid for the year 1809 and in consequence has been duly advertised according to law & put at auction to be adjudged in part to the person offering to pay the public, county, and poor Taxes thereon with all charges for advertising the same for the smallest part thereof and Robt. LOVE senr. Robert LOVE Junr. & Daniel McDOWELL of the co. aforesaid for Henry WOOD & others has offered to pay said taxes & charges amounting to $38.87 for 15,999 acres of said tract and no person has offered to pay the sum aforesaid for a less part of said Tract whereas the said Henry WOOD has presented to me a plat with the courses & distances of that part of said tract which was purchased for him the said Henry WOOD fairly setting fourth the same and is annex to this deed. Know all men by these presents that I, Daniel McDOWELL Sheriff of the co. aforesaid for an in consideration of the premises and of Henry WOOD proportion of the sum of $38.87 to me in hand paid I hereby Transfer to the said Henry WOOD a certain parcel of said tract lying on SCOTT’s Creek Including the mouth of the Rockhouse fork. Beginning on a hickory on thence with LEDBETTER’s line N 67 E 48 poles to a black oak then with William McCONNEL’s formerly BATTLE’s line N 80 poles to a hickory Thence W 171 poles to a stake thence S 96 poles to a stake and from thence to the beginning containing 100 acres. 23 Dec. 1813. Haywood Co. Whereas the taxes on a certan tract of land lying on both sides of Pigeon river in the Co. aforesaid remain due and unpaid for the year 1810 and in consequence thereof the same is now liable to be sold and has been duly advertised according to law and put up at auction to be agreed in part to the part to the person offering to pay the public, Co. and poor Taxes thereon with all Charges for advertising the same for the smallest part thereof and Holliman BATTLES of the Co. aforesaid has offered to pay said Taxes and charges for advertising amounting to one pound two shilling[s] three pence for 187 acres and one half the above tract being in the hole 188 acres and no person has offered to pay the sum aforesaid for less part of said tract and whereas the said Holliman BATTLE has presented to me within three months a plat made by Thomas C SINCLAIR surveyor of said Co. Now Know all men by these presents that I, Daniel McDOWELL Sheriff of the co. aforesaid for and in consideration of one pound two shillings and three pence I have transferred unto the said Holiman BATTLE a certain parcel of land lying on both sides of Big Pigeon River in the co. aforesaid. Indenture, 6 Oct. 1813, between Robert HENRY of the one part and John MONTGOMERY of the other part Witnesseth that the said Robert HENRY for & in consideration of one cent doth sell and convey to the s&aid John MONTGOMERY all Lands comprised within the following lines & without Bounds of a tract of land claimed by Waightstile AVERY or Thomas LENOIR which is now in suit. Beginning on a white oak on the S W bank of the E Fork of Pigeon in Haywood Co. AVERY’s corner & runs with his line S 200 poles to his other corner passing the same 19 poles to stake in Robert HENRY’s line N 56 W 138 poles to Robert HENRY’s beginning corner then N 34 182 poles to the beginning or first station The quality of acres not calculated. Know all men by these presents that I, Joseph BYLER of the Co. of Buncombe do for and in consideration of the sum of $50 paid by Robert LOVE of the co. of Haywood relinquish and make over to the said Robert LOVE all my right title claim and interest in one negro woman named Suckey and her five children which claim and interest has decended to me by intermarriage with Rebecca DILLARD my present wife as one of the Legatees of Anna DILLARD dec’d and I do by these presents warrant and defend unto the said Robert LOVE all the right and title Know have or ever had in the said Negro Suckey & her five children. 6 Oct. 1713 [1813] Jos BULER {ss}. Know all men by these presents that I, William CATHEY Senr am held and firmly bound unto James CATHEY in the full and Just sum of $500 to be void on condition that I do make or cause to be made a good and sufficient deed of conveyance to the one sixth part of the tract of land whereon I now live in which division quantity and quality is to be conserised and to inilade the improvement now occupied by the said James the Title to be made in a reasonable time after I receive a title for the same from John STROTHER the above obligation to be void otherwise to remain in full form and virtue. Witnesseth: that for and in consideration of the sum of $300 the said Robert KENNEDY doth convey unto the said Lazarus TILLEY a certain parcel of Land Situated in the co. aforesaid on both sides of a branch of Pigeon River called Sweetened branch it being the first Large branch running in on the E side of said River below where Joseph McCLURE lives Beginning on a white oak on the side of a hill running E 40 poles to a spanish oak thence 12 poles to a white oak thence E 54 poles to sowerwood thence N 24 poles to Chestnut thence E 128 poles to a white oak on the side of a mountain, thence N 98 poles crossing two branches to a spanish oak thence W 134 poles to a white oak on the side of hill thence S 28 W 88 poles to the branch thence S to the beginning containing 147 acres more or less the same being a large tract of land originally granted to David ALLISON. Know all men by these presents that I, John SITES of the Co. of Haywood for consideration of the sum of $300 hath bargained and sold unto my son Benjamin STILES a tract of land in the co. aforesaid on SCOTT’s Creek. Beginning on a maple forked from the root on the S bank of the Creek running thence crossing the Creek N 168 poles to a stake thence E 220 poles to a stake thence S with Zachariah COBES’ line to a stake on the S bank of the Creek and thence with the meanders of the creek to the beginning containing by estimation 200 acres more or less. 16 Apr. 1813. State of NC. To the Sheriff of Buncombe and Haywood Cos. Greeting Whereas lately in our court of Equity for the Co. of Burk wherein John McDOWELL was complainant and the heirs devises of John McDOWELL deceased was defendants I was decreed by the Court as follows (to wit) The Court by consent of parties makes and decrees the following order (to wit) that the Clerk and master issue and order to the Sheriff of Buncombe and Haywood Cos. to sell so much of the real estate of John McDOWELL senr. deceased as well devised as decended to his heirs and devises as will be sufficient to make the sum of $739.64 & interest thereon from 1 Mar. 1807 and such sale shall be called as or an execution or final decree and to take bond with Good and sufficient security payable to such sheriff within one year from this Term Mar. 1810. Know all men by these presents that I, Humphrey POSEY of the Co. of Haywood and State of NC for and in consideration of the sum of $450 paid by John PRUDE of the Co. of Buncombe & state aforesaid have sold unto the said John PRUDE one negro boy named Cato 18 years past and I do by these presents warrant the same boy to be sound healthy and sensible and clear of all incumbrances whatsoever. 3 Apr. 1813. Whereas the taxes on a certain tract of land in the Co. aforesaid on sococureo1ufty on the Raven’s Creek the property of William CATHCART remain due and unpaid for the year 1809 and in consequence thereof the same is now liable to be sold and has been duly advertised according to law and put up at auction to be adjudged in part to the person offering to pay the public co. & poor Taxes thereon with all charges for advertising the same for the smallest part thereof and Felix WALKER of the Co. aforesaid has offered to pay the said Taxes and charges amounting to 67 pounds 10 shillings for 29,992 acres of land out of 30,000 acres and no other person has offered to pay the sum aforesaid for a less part of said Tract and whereas the said Felix WALKER has presented to me a plat made by Thomas C ST CLAIR surveyor of said Co. Now Know all men by these presents that I, Daniel McDOWELL Sheriff of the said co. for and in consideration of premises and of the said sum have sold unto the said Felix WALKER a certain parcel or tracts of land being in the said Co. of Haywood. Beginning at a Spanish oak on CATHCART’s line 320 poles N 45 degrees W from his beginning corner at the head of Jonathan’s Creek running thence S 45 degrees W 1800 poles to a pine on CATHCART’s line with that line N 45 W 2666 poles to a stake thence N 45 degrees E 1800 poles to a stake on CATHCART’s line thence with that line S 45 degrees E, 2666 poles to the Beginning spanish oak. 2 Apr. 1812. Indenture, 28 Nov. 1809, between Sam’l HUGHES of the co. of Haywood of the one part & Joshua CHARCH of the co. aforesaid of the other part Witnesseth that the said Sam’l HUGHES for and in consideration of the sum of 25 pounds doth sell to the said Joshua CHARCK a parcel of land in the co. of Haywood lying as follows on the Pigeon River adjoining George CATHEY survey and beginning on a large white oak on the side of a ridge in the head of a hollow and running E 92 poles to a small hickory on CATHEY[‘s] line thence with said line S 186 poles to a small post oak on DEVERS’ line thence with said line W 75 poles crossing a small branch to a white oak thence N with and near sd branch to the beginning containing 100 acres conveyed from Wilson LOYD to Sam’l HUGHES and near to Joshua CHARCK [also spelled CLARCK]. Indenture, 8 Feb. 1814, between John FERGUS of the Co. of Haywood on the one part and Robert LOVE of the same Co. of the other part Witnesseth: that for and consideration of the sum of $400 paid by the said Robert LOVE and the aforesaid John FERGUS hath granted unto the said Robert LOVE a tract of land originally granted to the said John FERGUS by the State of NC by patent bearing date 19 Dec. 1804, No. 1488 containing 306 acres of land lying in the said Co. on both sides of SCOTT’s Creek and is Bounded as follows: Beginning on a hickory running N 250 poles crossing said Creek at or below the fork to a stake Thence E 104 poles to a stake thence S 63 degrees E 56 poles to a mountain birch at the mouth of the first branch on which there is a bridge or causeway below Littleberry BATTLES’ thence meanders up said branch what on a due E course will 58 poles to a stake thence S 20 degrees W 343 poles to a stake which will be 140 poles to the beginning. Indenture, 24 Dec. 1813, between William DEAVER and John BRYSON, Holiman BATTLE and John DOBSON Esquire commissioners appointed by an act of the General Assembly in the year 1808 for the purpose of fixing on a suitable place to erect the public buildings of the Co. of Haywood of the one part: and Robert LOVE all of the Co. of Haywood of the other part Witnesseth That for and in consideration of the sum of $87 paid by the said Robert LOVE the receipt & payment whereof is hereby acknowledged and the said Robert LOVE his heirs Executors and administrators Therefrom acquitted exonerated and discharged and the aforesaid William DEVER, John BRYSON and Holiman BATTLE & John DOBSON esquire as commissioners aforesaid hath granted unto the said Robert LOVE Two certain half acres Lots of land in the Town of Waynesville and known in the plan of said Town as Lots No. 18 and No. 22 as will more full appraise by a reference had to the place of said Town and which land was originally granted to John DAVIDSON & Robert LOVE as patent to them dated 30 Aug. 1802, No. 970 and from the said Robert LOVE as a donation to the aforesaid commissioners in Trust for the purpose of Erecting the public buildings in said Co. of Haywood as pr his deed to them dated 3 Nov. 1809 and is bounded as follows Beginning at a stake on the main street at the corner of the Lot No. 14 in the plan of said Town & which was by John WELCH Junr. Whereas the taxes on 100 [acres] of land the property [of] Mathew LEDBETTER lying on SCOTT’s Creek was due and unpaid for the year 1810, 1816 & 1812 and was duly advertised put up at auction to be adjudged in part to the person offering to pay the public co. and poor Taxes due thereon for the above three year[s] and Henry WOODS offered pay the same for 99 acres & 3/4 Now Know all men by these presents that I, Daniel McDOWELL sheriff of said Co. have Transferred unto the said Henry WOOD 99 acres & three quarter. Witnesseth for and in consideration of the sum of $300 have sold unto the said Daniel BYERS a tract of land lying E side of Pigeon River containing 100 acres more or less in said Co. Beginning on a white oak on the N side of a branch runs S 158 poles to a white oak near a cliff of rocks near the river bank thence W about 15 poles to a stake on the river bank thence down the various courses of the river to a Spruce pine on the river bank thence E 150 poler ples to the beginning containing 100 acres be the same more or less. Indenture, 29 Mar. 1814, between Addle OSBORNE of the Co. of Iredele of the one part and Edward HYATT of the Co. of Haywood of the other part. Witnesseth that the said Addie OSBORNE for consideration of the sum of $575 hath sold unto the said Edward HYATT all that tract of land lying in the Co. of Haywood on both sides of small creek That runs into Richland Creek on the W side thereof. Beginning at the SW corner of 50 acres of land heretofore conveyed to William KENNEDY thence running N and E with the line of the said 50 acres to the sd. E corner of a tract of 640 acres of land granted to Addie OSBORNE by Grant No. 1087, dated 1803 thence with last tract mentioned line N to Waightstile AVERY’s line thence with his line No. 34 W 83 poles to the N boundary line of said tract S 284 poles to a stake the SW corner of said tract then E with the S boundary line of said tract to the beginning being all that tract and parcel of land heretofore granted to the said Addie OSBORNE [also spelled Adlar; should be Adlai] No. and dated as aforesaid excepting 50 acres thereof heretofore sold to William KENNEDY and except so much thereof is taken by an older Title to Capt. Know all men by these presents that we Benjamin STILES and Charles STILES of the State of NC for and in consideration of the sum of $500 hath leased unto our father John STILES for and during the term of his natural life and that of our mother all that tract of land which was granted originally to him and by him sold to us lying and being in the co. aforesaid [sic] on both sides of SCOTT’s Creek. Witnesseth that for and in consideration of the sum of $30 the said John STROTHER doth hereby sell unto the said George OWENS a certain parcel of land containing 20 acres in the co. of Haywood on the waters of Pigeon River and on Jonathan’s Creek in two tracts. State of NC, Haywood Co. Whereas the Taxes on such part of a certain tract of land lying on SCOTT’s creek in the co. aforesaid the reputed property of William CATHCART to which the Indian claim have been extinguished, remain due and unpaid for the year 1809 and in consequence thereof the same is now liable to be sold and has been duly advertised according to law and put up at auction to be adjudged in part to the person offering to pay the public, county and poor taxes thereon with all charges for advertising the same for the smallest part thereof and Robert LOVE Sen, Robert LOVE Junr & David McDOWELL of the co. aforesaid for John MORROW and others has offered to pay said Taxes and charges amounting to $38.87 ½ for 15,999 acres of said tract and no other person has offered to pay the sum aforesaid for a less part of said tract whereas the said John MORROW has presented tome a plat with the courses and distances of that part of said tract which was purchased for him the said John MORROW fairly setting fourth the same; now know all men by these presents that I, Daniel McDOWELL Sheriff of the co. aforesaid for and in consideration of the premises and of the said John MORROW[‘s] proportion of the said sum of 538.87 to me in hand paid by the said John MORROW the receipt whereof I hereby acknowledge have bargained and sold unto the said John MORROW a certain parcel of land lying on the waters of SCOTT’s creek in the co. aforesaid.
