Whereas certain Judgment was obtained by Abramham EATON Esqr. against Alexander COLDWELL and Execution is heard thereon which was leveyed on a certain piece of land in the Co. aforesaid lying on SCOTT’s Creek ajoining lands of John McDOWELL and Benj. ODELL containing 100 acres more or less…I, Daniel McDOWELL, sheriff of said Co. have exposed the same to public sale and Henry WOODS became the highest bidder for the sum of $7. Know all by presents that I, Daniel McDOWELL, Sheriff for consideration of the above some [sic] have transferred unto the said Henry WOODS the above 100 acres of land. Whereas taxes on such part of a certain tract of land lying on SCOTT’s Creek in the Co. aforesaid the reputed property of William CATHCART to which the Indian claims have been Extinguished remain due and unpaid for the year 1809 and consequence thereof the same is now liable to be sold…at auction…to the person offering to pay the public, Co. and poor taxes…and Robert LOVE, Sr., Robert LOVE, Junr. and Daniel McDOWELL of the co. aforesaid for Zachariah COBE and others has offered to pay said taxes and charges amounting to $38.50…Now Know all men by these presents that I, Daniel McDOWELL Sheriff of the co. aforesaid consideration of the premises and of the said Zachariah COBE’s proportion of the said sum of $2.50 I hereby transfer unto the said Zachariah COBE a certain tract of land lying on SCOTT’s Creek in the Co. aforesaid Beginning on a white oak thence with John STILES’ line W 90 poles to a stake and form thence N 179 poles to a stake thence E 90 poles to a stake thence to the beginning. 3 Aug. 1812 acknowledged Daniel McDOWELL Sheriff {Seal}. Know all men by these presents that I, Robert CARTER of the Co. of Haywood held and firmly bound to John DILLARD in the full and Just sum of $500 to be paid unto the sd John DILLARD his heirs executors and administrators or assigns to which payment well and truly to be made and done I bind myself my heirs administrators Jointly by these presents 10 Jul. 1813. The condition of the above obligation is such that if the above bounded Robert CARTER shall and will forever hereafter hold his peace concerning the above named John DILLARD and his family and the said CARTER so conducting himself as to debase himself from utterize publicly or privately malicious or scandalous reports on sd DILLARD his wife or family and further that the said CARTER do retract any and everything heretofore sd by him the sd CARTER respecting the conduct of said DILLARD and family then and that case the above obligation to be void otherwise to continue in full force and virtue. Know all men by these presents that I, Holliman BATTLE of Haywood Co. have appointed James WELCH of the co. aforesaid my legal Attorney in my name in all and every business which may hereafter be done or have to be done and with the Register’s office of sd co. until I am legally discharged from the United State service which I am now bound to comply with and to collect all book accounts and other debts which is due me ratifying whatever my sd attorney may do in as full and ample a manner as I may myself could or might Do were I personally present. 25 Aug. 1813.
