Indenture, 16 Mar. 1812, between Daniel McDOWELL Esqr. High Sheriff of Haywood Co. of the one part and John McDOWELL of the Co. of Rutherford within the State of NC of the other part Witnesseth that by virtue of an order & Decree of the courts of equity within the Co. of Burk which order and decree is transcribed at the end of this deed which order and decree was made in a suit in the said Court of equity wherein John McDOWELL was complainant & the heirs & divises of John McDOWELL Deceased were defendants for the sum of $739.84 with interest which sum recorded by the said John McDOWELL in manners as expressed in the said Decree against the heirs and devisees of the said John McDOWELL deed as on record may appear and whereas the said order and decree was directed and delivered to the said Daniel McDOWELL Sheriff as aforesaid demanding his to sell so much of the real estate of said John McDOWELL deceased as would be sufficient to satisfy the sum aforesaid with costs renewing and those previous to that time wish amounts to 37 pounds & seven shillings and one penny the said Daniel McDOWELL Sheriff as aforesaid pursuance of said decree and by virtue of his office did seize tracts lying the said Co. of Haywood… Witnesses: H. Know all men by these presents that I Alexander McCLURE of the Co. of Haywood of the one part and Henry PLOTT of the Co. aforesaid of the other part. Witnesseth that for and in consideration of the sum $250 to me in hand paid I do hereby acknowledge and that I the aforesaid Alexander McCLURE do by these presents convey unto him the aforesaid Henry PLOTT certain part of a tract of land, lying in the Co. aforesaid and on Pigeon River, the tract or all that part of a tract lying on the E side on the river where I now live and including the improvements. Beginning on the W side Pigeon River on a white oak on the N side of a hill and runs thence N 200 poles crossing the river to a white oak, thence west 160 poles to a white oak, and thence E to the beginning. 3 Oct. 1810. 7 Oct. 1803. In the sum of $2,000 we Joseph DOBSON, Joseph TURNER, Aron BRITTON do bind ourselves our heirs Executors unto each other …comply with the agreement which is as follows. The said DOBSON, TURNER and BRIITENhath agreed that as their land Closhd [sic] on each other DOBSON and BRITTON in partership and TURNER a purchaser from Phillip HOODENPILE in consequence of which TURNER had a foot and recover a Judgment on HOODENPYLE for the sum of 1000 pounds which thousand pound the said Joseph TURNER doth agree to divide equally between the said DOBSON and BRITTON as soon as collected and DOBSON pays the said TURNER land worth of the land whereon Andrew WELCH lives which TURNER land to the worth of the land whereon Andrew WELCH lives which DOBSON sold to said WELCH and TURNER has an older title DOBSON has the privilege of paying land in Burk or Buncombe to the value of said land without improvements. Know all men by these presents that I William COLVARD of Haywood Co. have constituted and appointed James WELCH of the Co. aforesaid My Legal attorney to receive my part of a Negro fellow named Peter and a wench named Ursula which were left by John MERRYMAN of the Co. of Cumberland and State of VA unto Juda COLVARD my mother and at her decease to the heirs of the said Juda lawfully begotten by my father John COLVARD now of the Co. of Saura [Surrey] and State of NC together with all the increase which has or may proceed from the same wench and use all Legal meanes for obtaining the same wench and increase as I myself could or might do were I personally present and the said Negroes when obtained are to before this sale use and behoof of the sd James WELCH his heirs or assigns forever. Indenture, 29 Sep. 1810, between Robert LOVE of Haywood Co. and Peter PENLAND of the Co. aforesaid. Witnesseth that whereas by an agreement made on 13 Sep. 1809 in which agreement the said Robert LOVE convey[ed] by Deed of release and quit claim to him the said Peter PENLAND all the right title and dame which he the said Robt LOVE had by purchase at a Sheriff sale of Joseph DOBSON undivided [illegible] of a 400 acres survey which was granted to the said Joseph DOBSON and John STROTHER by Patent bearing date at Raleigh 7 Dec. 1803-No. 17130 and bounded as followseth: one the W side of Pigeon river Joining above Robt ROADS tract formerly now George CATHEYs and including the PENLAND old place. This agreement made and cloncluded upon this 16 Aug. 1810 between Jossey ANDERSON and John WELCH both of the Co. of Haywood are as follows: First the[y] agree to go equal partners in six lots in the town of Waynesville in Haywood Two of which was purchased by said ANDERSON son of the commissioner for said town and the same whereon the said ANDERSON now keeps store, and the other four being the same that the said WELCH has purchased of said commisionors for which lots the[y] are each to pay an equal part of the first cost by purchase and to be at an equal expense of all improvements on said lots in the second place the[y] are to set up a house of public entertainment which the said WELCH is to superintend Keeping a Just Register of all provisions and forage at the first cost he says in for the use of said house at the expense of which provision is to be reducted from the whole produce of the house to be equally divided between said WELCH and ANDERSON in the third place the[y] are to set up a store of goods, wears, and merchandise at the aforesaid town…is to be equally divided between the said ANDERSON and WELCH which partnership is to be continued for the term of seven years. Know all men by these presents that I, Alexander COLDWELL of the Co. of Haywood in consideration of the sum of $50 paid by George SHOALER in-behalf of his brother John SHOOLER to me as lawful attorney for William Lewis COLDWELL have taken the same as full satisfaction for a [illegible] which the said John SHOOLER give to or instituted on the sd William Lewis COLDWELL and by these presents entirely release him from all cost or damage which might in any matter accrue from suit instituted by or in the Superior Court of Law in the Co. of Buncombe as Attorney for sd William Lewis COLDWELL and if so sd John SHOOLER should ever be arrested in consequence of the above suit the affair so arresting is hereby required to liberate him and for the true performance of the above I bind myself in the sum of $200. 18 Mar. 1812. Haywood in consideration of the sum of $200 paid by Mark COBMAN of the Co. of Cabarass have sold unto NathaniaI ALMAN of the Co. of Haywood one parcel of land containing 32 acres and 45 poles lying in our Co. of Haywood on Racoon Creek a fork of Ritchland being the lower end of a tract of land Granted to Joseph DOBSON by a State patten. Beginning on a branch [illegible] on the bank of said creek runs thence W 29 poles to the beginning corner of the original survey thence S 140 poles to a stake thence N 45 E 104 poles to the Forks of a branch thence with the meanders of said branch to the beginning on the said corner at his lower end of his other place of 32 acres and 45 poles. Beginning at a hickory marked as a corner & the beginning corner of a 500 acre survey Granted by the state of NC to Joseph DOBSON & John STROTHER bearing date at Raleigh 7 Dec. 1808 No. 1729 on the W bank of Pigeon River runs S along a line of marked trees to a pine tree near a branch then W 337 poles to a post oak [illegible] the corner of a survey of 100 acres reserved of the W end of said 500 acre Grant to and for the use of John STROTHER then N with sd line 219 poles to a large white oak corner to BELLAH’s land. Indenture, 3 Oct. 1800, between Hezekiah ALLEN of the Co. of Haywood & David McPETERS of the Co. aforesaid of the other part – Witnesseth that in consideration of the sum of $100 Hezekiah ALLEN doth convey unto we said David McPETERS a certain parcel of land containing 50 acres more or less being in the Co. of Haywood on the waters of Beverdam Creek of Pigeon River. Beginning on a white oak on the top of a hill and then running N 66 poles to white oak Thence S 80 E 124 poles to Isaac ECTION’s line and with his line S 78 poles to a piece thence to the beginning containing 50 acres more or less. Indenture, 10 Apr. 1809, between John STROTHER of the Co. of Haywood of the one part and David McPETERS of the Co. of Haywood of the other part Witnesseth that for and in consideration of some of $200 paid by the said David McPETERS whereof the said John STROTHER doth hereby convey unto the said David McPETERS a certain parcel of land containing 158 acres and three quarters of an acre in the Co. of Haywood on the waters of Pigeon river. Beginning at a large white oak on KILLIAN’s line and runs E eight poles to a small hickory a corner to MOORE’s land and with his line E 120 poles crossing the garden Creek to a hickory… the same being part of a large tract of land originally granted to David ALLISON. Whereas John STROTHER did enter into an agreement on 14 Apr. 1803 with James McDOWELL since dec’d that on consideration the said James [McDOWELL] would well and truly pay him $25 that he would quit his claim to all part of his tract Lying on the W side of Pigeon River including the mouth of a small creek and his improvement and whereas William McDOWELL & John McDOWELL Sons and heirs of the said James has since their father deceased made payment in full. Haywood Co. Whereas the Taxes on such part of a certain tract of land lying on SCOTT’s Creek in Co. aforesaid the reputed property of William CATHCART to which Indian claim has been Extinguish remain due and unpaid for the year 1809 and in consequence thereof the same is now liable to be sold and has been duly advertised according to law and put up at auction to be agreed in part to person offering to pay the public county, and poor tax, thereon with all charges for advertising the same for the smallest part thereof and Robert LOVE senr. Robert LOVE Junr. and David McDOWELL of the Co. aforesaid for David ADAMS and others has offered to pay said Taxes and charges amounting to $38.87 for fifteen thousand 999. acres of said tract and no person has offered to pay the same for less part of the said tract whereas the said David ADAMS has presented to me a plat with the courses and distances of that part of said tract which was purchased for him the said David ADAMS fairly settling fourth the same…Know all men by these presents that I Daniel McDOWELL Sheriff of the Co. aforesaid in consideration of the premises and of the said David ADAMS’ properation of the said sum $38.87 do sell unto the said Daniel ADAMS a certain part of said tract of land on SCOTT’s Creek in said Co. 22 Sep. 1812.
