Note: Although the Erath County Courthouse lost records in a courthouse fire in 1866, many of its earliest deeds exist because buyers re-recorded their transactions to prove ownership. However, deeds were often not filed for several months or even years after the transaction.

TOLIVER for and in consideration of the following sums of money realized by me from the sale of my said wife’s separate property (viz) Seventy four acres of land of the headright of John HUFF, being in Wharton County Texas, sold by me in Oct 1855 for eleven hundred and ten Dollars in gold, and interest on same up to date, nine hundred seventy six dollars. Also five negroes, a woman and her three children, and a negro boy sold by me to J. C. CLARK, for thirty five hundred Dollars in gold in Dec 1856, and interest on same up to date, Twenty eight hundred and ninety three Dollars. Also two negroes, a man and a woman sold by me to J. W. SMITH in July 1859 for Two thousand five hundred dollars in gold and same up to date, fifteen hundred and fifty two Dollars, amounting in the aggregate to the sum of Twelve Thousand and thirty one Dollars, principle and interest as before mentioned, for and in consideration of of [sic] said sums of money in gold, received by me from said sales of said separate property of my said wife I have this day bargained and sold and by these presents do bargain sell and convey to my said wife the following described real and personal estate (viz) Lots No. four (4) five (5) or six (6) in Block No. One (1) in the town of Stephenville on public square, being the same property now occupied as a homestead together with the buildings and improvements situated thereon at the sum of Six hundred Dollars, also my stock of cattle running on the range in Eastland and adjacent counties, branded with a horse shoe, marked, principally cross & split in the left ear and under half cross in the right ear, supposed to be about twenty five hundred head at four Dollars per head. . . . Also six horses at the Ranch Cow ponies at fifty Dollars apiece. .. Also a piano in Bosque County as this time at Two hundred Dollars and also a wagon at one Dollars amounting all together in the aggregate in value of Eleven Thousand two hundred & fifty Dollars. Pages 19-20. Record No. 17. Erath County: By virtue of a certain execution issued out of the Justice’s Court of Beat No. 1, Class No. 1, in aforesaid County, in favor of J. C. LOWE vs. T. N. DREW on a certain judgment rendered on the first Saturday in August 1861 and directed and delivered by me as Sheriff, “commanding me of the goods, chattels, land & tenements of DREW to make certain money… I, John WALLER, Sheriff, did upon the 29 day of Aug. 1861, seized…property and sold at public vendue.” Premises “were struck off” to J. B. BRUMLEY for $20.40, he being the highest bidder.

Pages 22-23. Record No. 19. By virtue of a certain execution issued out of the District Court of Fayette County, Texas, in favor of J. W. RANDAL & Co., vs. George A. MISKELL, on a certain judgment rendered on 6 May 1853, John R. WALLER (as Sheriff) seized all the estate, right, title and interest to the premises. It was sold to W. H. BLAINE and J. C. BRUMLEY for $26.00. Described as 640 acres granted by the state to MISKELL in Milam District on the western tributary of the Bosque River in the lower part of the Cross Timbers. 2 October 1860.

Pages 25-27. Record No. 21. Houston, Harris County, Texas: Emiline PERKINSON, widow of Edward PERKINSON; Elizabeth S. EWING and her husband, George EWING; John PERKINSON; Louisa PERKINSON and Elvina TOLIVER, all of Harris County; Amanda DUPREE, wife of Joel R. DUPREE and Joel R. DUPREE of Montgomery County, Texas, sole heirs at law of Edward PERKINSON, to Jacob DE CORDOVA. Whereas the said Edward PERKINSON in his lifetime was entitled to one league of land from the Government of Texas, his headright which was surveyed and located by the said Jacob DE CORDOVA for the benefit of the said Edward upon an agreement that the said DE CORDOVA was to be at all expense of the survey, location and patenting of said land for the whole of which he was to have the one undivided third part thereof. “And whereas on the first day of September A. D. 1847, The State of Texas . . . granted by Patent of that date numbered 492, Vol. 5, to the heirs of Edward PERKINSON . . . one league of land situated . . . in Milam District on the Paluxy five miles above its junction with the Brazos River. . .” 28 March 1861.

STEPHEN and Thomas ARENDELL, both of Erath County, joint owners of 1,016 acres in said county (a portion of the grant in the name of Jarrett MENIFEE), conveyed to them by Albert GOLSON, grant a tract of that land to William MEFFORD of Erath County. STEPHENS and ARENDELL were paid $320.00 for 250 acres, “on which MEFFORD now resides,” about two miles above Stephenville. (Signed) John M. STEPHENS and Thomas ARENDELL (his mark). Witnesses: J. L. O’NEAL of Erath County, in consideration of $2,335 due him by HARTJE & Sons of Parker County, for which sum he has this day executed his promissory note due 24 July 1867 to be discharged in 157 good merchantable beeves four years old and upwards to be delivered at or within five miles of Stephenville. For the performance of said proposal, John R. O’NEAL grants to J. C. BRUMLEY, as trustee, his entire stock of cattle in Erath and adjoining counties. 5 June 1867. (Signed) J. R. The land was the southern portion of a tract granted to William PARVIN, deceased, by Letter Patent dated at Austin, 30 March 1854. The tract was described as being on the head waters of the main Bosque about 28 miles S 73° W from Comanche Peak by virtue of Bounty Warrant No. 1240 issued by the Adjutant General on 5 March 1853. It was acquired by BRUSH by purchase from John KAMPER by deed dated 7 October 1858. “This conveyance is intended as a mortgage to secure the payment of the sum of One hundred and fifty Dollars, on the day of August A D 1867. One hundred dollars of which said indebtedness was incurred this day by the loan thereof, by the said party of the second part to the said parties of the first part, and the remaining fifty Dollars of said indebtedness being the amount due under a deed of mortgage executed by the said BRUSH & wife in favor of William McDONALD and Chas. Pages 76-77. Record No. 67. Smith County, Texas: William DAVENPORT, formerly of Rusk County, Texas, now of Shreveport, Louisiana, for and in consideration of the sum of $1,307.18 grant to Stockton P. DONLY of Smith County a parcel of land on the waters of Squaw Creek in the NE portion of Erath County. The tract, containing one half league or 2214 acres, was a surveyed as a headright for Rachael STORY. “The said half league of land . . . being decreed to me by the District Court of Shelby County . . . being the only tract of land which I own in the said County of Erath.” The seller was indebted to the buyer for $1,307.18, of which $126.50 was payable on 1 January, with 12% interest and the remainder ($1,180.68) due on 1 January 1868, with 12% interest from the date till paid. “I have this day & executed and delivered to said Stockton P. DONLEY my notes bearing date this day and due as above stated. Now if I shall pay off said notes when the same shall become due with all interest if any that may accrue said notes & each of them, then this Conveyance shall cease and be of no further force, validity and effect. . .” (Signed) William DAVENPORT. State of Texas, County of Erath: I, Joseph SALMON being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore declare this to be my last will and testament. That is to say, First: After all my lawful debts are paid and discharged the residue of my estate, real and personal, I give, bequeath and dispose of as follows: ‘to wit:’ To my beloved wife Elizabeth, all my property or so much thereof as she needs during her natural life, should she out live me and remain single. Should she marry again, she is to have one bed, furniture and clothing and three cows and calves; And to my son Joseph, I give 160 acres of land lying on Resley’s Creek in Comanche County and known as the Neal Survey, And I give my daughter Martha, one horse beast to be worth $125.00. The balance of my property I wish to be divided equally amongst all my children, Joseph and Martha to share in this division, equal with the others, except I desire my son-in-law Samuel V. EDWARDS to have the land on which he lives, beginning at the south east corner Thence with the line to the Creek, Thence up the South Branch to a burr oak marked S. Thence South to my line supposed to be 30 acres, the value of the same to come out of his portion of the balance of my estate. I also appoint my son John SALMON to be Executor of this my last will and testament I hereby revoking all former wills by me.
